August 30, CALGARY: A man accused of being a Calgary gang member has received a last-minute reprieve that will prevent his deportation to Vietnam, at least for now.
Jackie Tran was granted an emergency stay Saturday night.
Justice Yves de Montigny made the ruling, which will allow Tran to stay in Canada as a judicial review of his case is decided.
The 26-year-old was scheduled to be deported this week.
“Obviously he’s very pleased,” lawyer Raj Sharma said of Tran’s reaction to the news.
The Canada Border Services Agency has sought to deport Tran, and a removal order became valid in April after an immigration appeal division decision refused to overturn Tran’s deportation. He was first ordered deported from Canada in 2004.
At Friday’s hearing, Sharma argued there are serious deficiencies in the appeal division decision and his client should not be deported as a judicial review of his case is still before the Federal Court.
Police have accused Tran of being a member of the FOB Killers, a Calgary gang that has been locked in a bloody feud with the rival gang FOB. Tran has denied being a member of the gang, but has acknowledged social connections with some members.
Tran is currently in custody where he awaits a detention review scheduled for Wednesday.
